Patent Price List - How Much Does It Cost to Get a Patent?


The following prices are illustrative only. The actual cost of preparing, filing and prosecuting a patent application will vary greatly from case to case depending on the type of invention, the complexity of the patent application and the complexity of the patent prosecution. Patent Searches

  • Quick Online Search - FREE with a consultation.
  • Patentability Search - from $1,000 to $1,500 (plus GST) depending on the type of technology, how crowed the area of art is and the scope of the desired search.

Patent Applications

  • Simple Invention - from $2,500 to $4,000 (plus GST) depending on the area of technology, the type of prior art provided, the quality of any written disclosure provided by the inventor and the availability of drawings (or the level of complexity of the drawings required).
  • More Complex Invention - from $3,500 to $5,000 (plus GST) depending on the area of technology, the type of prior art provided, the quality of any written disclosure provided by the inventor and the availability of drawings (or the level of complexity of the drawings required).
  • Complex (or involved) Invention - from $5,000 to $8,000 (plus GST) depending on the area of technology, the type of prior art provided, the quality of any written disclosure provided by the inventor and the availability of drawings (or the level of complexity of the drawings required).

    NOTE: Complexity depends on many factors including the area of technology, the number of component parts (if a machine), the number of steps (if a method), the number of variations or adjustable parameters, the closeness of prior/related art, the nature of the drawings and the quality of the materials provided by the inventor.

 

Prosecution / Processing of Application

From $1,000 to $7,000 assuming no appeals or continuation applications are filed. The cost varies greatly from case to case depending on where the patent application was filed (Canada, the USA, Europe, etc) and the number and nature of office actions. We cannot provide a precise estimate of the costs of patent prosecution, and can only provide a range.

 

Government Fees

In addition to the above referenced fees, there will be several government fees due on the filing of the application and during the course of prosecution. These fees include the filing, examination, maintenance, and issue/publication fees. In addition, there may be completion fees, extension fees and reinstatement fees, depending on how the application is prosecuted. The following is a sampling of these fees for Canada and the USA. Please refer to the USPTO and CIPO web sites for an up to date list of fees.

  • For Canada - Filing fee $200, examination fee $400, issue fee $200 and annual maintenance fees $50 (for small entity).
  • For USA - Filing fees $500 and issue/publication fee $1,200 (for small entity).
